Cisco Vendor Successfully Resolves Major Fraud & Counterfeit Litigation
Successfully resolved a major fraud/counterfeit litigation brought by Cisco Technologies against Stradling’s client, a former Cisco vendor, alleging that the vendor unlawfully diverted tens of millions of dollars of Cisco product for resale on the secondary market or “gray market” for IT hardware.
Cisco originally filed the case in the Northern District of California, but Stradling successfully transferred to the Northern District of Texas (where the client is located) over Cisco’s opposition. After multiple successes in motion practice—including successfully opposing Cisco’s motion to dismiss the client’s counterclaims against them for defamation and business disparagement—the case was dismissed pursuant to a settlement.
