Coast Dental Secures Dismissal With Prejudice
Secured a rare dismissal with prejudice on behalf of Coast Dental Services ("Coast") in a matter arising out of the sale of a group of its dental offices. Coast owned and operated more than 150 dental offices across the United States, but decided to exit from the California market. As a result, it sold more than 50 dental practices to nine different buyers. Two of those buyers filed “buyer’s remorse” cases - one went to arbitration and the other in federal court. In the federal court case, in addition to contract claims, the plaintiff/buyer alleged RICO and fraud claims based upon a variety of supposedly false representations such as artificially inflated financial data and misrepresentations about staffing. The court found that the plaintiff could not possibly cure his defective claims.
