Court Denies Class Certification Against Agricultural Employer
Stradling successfully defeated class certification on behalf of an agricultural employer in a lawsuit that alleged wage and hours claims for unpaid overtime, non-compliant meal and rest periods, failure to reimburse for business expenses and related claims. After discovery, the plaintiff filed a motion for class certification, which was denied as to all claims. The court agreed that the plaintiff had not presented substantial evidence that our client had common noncompliant policies that applied to the asserted claims, borrowing extensively from our client’s papers in the court’s written judgment.
