Publicly Traded Food Distributor Obtains Full Withdrawal in Prop 65 Case

Stradling secured a victory on behalf of a food manufacturer and distributor obtaining a full withdrawal of an alleged violation of Proposition 65 prior to any formal legal proceedings. The plaintiff alleged that our client’s products contained concentrations of a naturally occurring chemical in violation of the statute, and that the product required proper warnings or to be reformulated. After reviewing plaintiff’s evidence along with existing precedent and other technical data, Stradling demanded that plaintiff withdraw the complaint (which also named Albertsons Grocery Companies), which it did.
