Private Equity Firm Resolves Rep & Warranty Dispute

Represented a private equity firm and a subsidiary, who took out buyer-side rep and warranty insurance when they acquired a controlling interest in an aerospace manufacturer. Upon discovering the breach of seller reps and warranties, we made a claim for the policy limits.

The underwriters initially denied coverage. After an initial round of mediation, we had settlement discussions, which proceeded far enough to schedule a second mediation session on November 23, 2022 where the matter was favorably settled for our client.
