Food Companies Secure Dismissal with Prejudice in Proposition 65 Matter
Secured a dismissal with prejudice and costs on behalf of two defendant food companies. Plaintiff alleged that our clients manufactured, sold, and/or distributed a food product that exposed consumers to a chemical in violation of Proposition 65. When Plaintiff failed to comply with Proposition 65’s pre-suit notice requirements that aim to help parties resolve disputes short of litigation, Stradling successfully moved for a dismissal based on Plaintiff’s non-compliance.
