Stradling Team Secures Dismissal for Former CEO of Proove Biosciences in Health Care Fraud Case

On December 21, 2022, a Stradling team led by Jason de Bretteville and Shawn Collins, along with Lisa Northrup, Sean Lobb, Tucker Atkins, and Kathy Hammersly secured a rare voluntary dismissal on behalf of a former CEO of an Irvine based Proove Biosciences a month before trial in a health care fraud case. Stradling represented the lead defendant in a nine defendant white collar criminal defense case where the U.S. Attorney’s Office for the Southern District of California alleged a $45 million Medicare fraud conspiracy.
Our team worked relentlessly to identify and forcefully articulate serious problems with the government’s case on multiple fronts, including substantive defenses pointing towards factual innocence, as well as issues arising from the government’s mishandling of privileged information. That work led directly to the government’s decision to abandon its case as to all defendants on the eve of trial, thus allowing our client to resume his life as an entrepreneur and the doctor defendants to continue to help their patients cope with chronic pain.
